It should be remembered, that the past 8 June 2020, by resolution of the reference process 21-2020, the Constitutional Chamber of the Supreme Court of Justice declared unconstitutional executive decrees no. 5, 12, 14, 18, 19, 21, 22, 24, 25, 26 Y 29, regarding mandatory home quarantine, as well as the Law of Temporary Restriction of Concrete Constitutional Rights to Attend the Pandemic by Covid-19, and the Isolation Regulation Law, Quarantine, Observation and Surveillance for COVID-19. https://www.jurisprudencia.gob.sv

This Court established that the reasons why it is necessary to suspend the constitutional rights of Salvadorans were not sufficiently justified, as well as the usurpation of legislative functions by the executive body, under the understanding that it lacks competence to issue regulations that suspend constitutional rights and guarantees.
